# Terms of Service *Last updated: August 29, 2026* Makenotwork is operated by Make Creative, LLC ("we", "us", "our"). By using our service, you agree to these terms. ## The Short Version - You own your content - You're responsible for your content - We provide the platform, you provide the creativity - Don't do illegal things - Either party can end this relationship anytime ## Accounts ### Eligibility You must be 18+ or the age of majority in your jurisdiction to create a creator account. Fan accounts require you to be 13+ (or your jurisdiction's minimum). ### Account Security You're responsible for your account credentials. Enable two-factor authentication. If you suspect unauthorized access, contact us immediately at security@makenot.work. ### Account Types - **Creator accounts**: Pay a monthly tier fee, can upload and sell content - **Fan accounts**: Free, can purchase and access content ## Creator Terms ### Your Content You retain all rights to content you upload. By uploading, you grant us a license to host, display, and distribute your content as necessary to operate the service. ### Revenue We charge 0% platform fee on fan payments. Payment processing fees (~3%) are deducted before funds reach you. ### Prohibited Content Don't upload: - Content you don't have rights to distribute - Illegal content (varies by jurisdiction) - Content that violates others' rights - Malware or harmful code ### Content Moderation We remove content that violates these terms. We try to give notice before removal when possible. See [Content Moderation](./moderation.md) for details. ### Subscriber Lists If you run a project mailing list, you and Makenotwork are joint controllers of the subscriber data on it. The arrangement is set out in [Mailing List Data Processing](./mailing-list-data-processing.md), and running a list means you agree to it. Exporting your subscriber list puts a copy of those addresses on your own machine, outside our database. While you hold such a copy: - You must not mail an address after it has been erased. - You must delete the exported copy of an address once we tell you an erasure covers it. - You are responsible for keeping the copy secure for as long as you hold it. A list you mail from another service is yours to answer for, and we are not a controller of it. That does not release the obligations above, which follow any address you took from us. ## Fan Terms ### Purchases When you buy content: - You get a license for personal use - You can download and keep files - You can't redistribute or resell - One-time purchases: access persists even if the creator leaves ({{ policy.buyer_access_days }}-day download window) - Membership-gated content: access persists during the {{ policy.buyer_access_days }}-day grace period if a creator deletes their account. After {{ policy.buyer_access_days }} days, content is removed. Active memberships are not billed during this period ### Memberships - Billed monthly - Cancel anytime - Access continues until end of billing period - No refunds for partial months ## Data & Privacy See our [Privacy Policy](./privacy-policy.md). Summary: - We collect minimal data - We don't track you - We don't sell your data - You can export or delete your data If you run a project mailing list, [Mailing List Data Processing](./mailing-list-data-processing.md) sets out who answers a subscriber's request and what you agree to as a joint controller. ## Termination ### By You Cancel anytime. Export your data first. Creator memberships end at the billing period. ### By Us We may terminate accounts that violate these terms. We'll provide notice when possible and allow data export for non-egregious violations. ## Disclaimers The service is provided "as is." We do our best but can't guarantee uptime, data integrity, or that you'll make money. Back up your content. ## Liability Our liability is limited to the amount you've paid us in the past 12 months. We're not liable for indirect damages, lost profits, or lost data. The disclaimers and limits in this section do not override the specific commitments in [What We Guarantee](../about/guarantees.md), including uptime, data preservation, backup, shutdown notice, and founder-pricing lock-in. Where this section and the Guarantees conflict, the Guarantees control. ## Disputes We prefer to resolve disputes directly. If that fails, disputes are governed by Colorado law and handled in Colorado courts. ## Changes We may update these terms: - **General changes**: 90 days notice before they take effect - **Privacy policy changes**: 90 days notice before they take effect - **Pricing changes**: {{ policy.price_change_notice_days }} days notice + grandfathering at current rate for at least {{ policy.grandfather_months }} months (see [guarantees](../about/guarantees.md)) - **Exceptions**: Changes required by law, court order, or to address an active security threat may take effect immediately We'll notify you by email when terms change.
